Terms and Conditions of Use of CasaEnOrden

These Terms and Conditions (the "Terms") govern access to and use of the CasaEnOrden mobile application (the "Service" or the "App"), offered by Camilo Henao Navarro, an individual domiciled in the Republic of Peru (the "Provider," "we," or "CasaEnOrden").

By creating an account, signing in, or using the Service in any way, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into this document by reference. If you do not agree, you must not use the Service.


1. Acceptance of the Terms

1.1. Using the Service constitutes full and unconditional acceptance of these Terms, as in effect at the time of use.

1.2. If you accept these Terms on behalf of someone else (for example, as a responsible adult authorizing a minor under Section 3.1), you represent that you have the authority to do so and accept responsibility for that person's compliance.

2. Description of the Service

2.1. CasaEnOrden is a tool for organizing and recording household expenses and contributions. It lets a group of people who share household expenses (a "Household"):

  • Record recurring services and expenses (for example, rent, electricity, water, internet).
  • Define how each expense is split among Household members.
  • Keep a record of payments made by each member and of balances outstanding according to what is recorded in the App.
  • Receive reminders about upcoming due dates.

2.2. CasaEnOrden is not a financial institution, a payment gateway, an electronic wallet, or an entity supervised by any banking or financial authority. The Service does not process money transfers, does not move funds between users, and does not hold or custody money at any time. The "payments" recorded in the App are informational entries that each user manually enters to keep clear accounts with the other members of their Household; the corresponding money, if any, changes hands outside the App (cash, bank transfer, a third-party digital wallet, etc.).

2.3. Accordingly, CasaEnOrden does not verify, guarantee, or take responsibility for whether a payment recorded in the App actually occurred in real life, nor for the accuracy of the amounts, splits, or balances that result from information users themselves enter. See Section 5.

3. Eligibility and Accounts

3.1. Minimum age

You must be at least 13 years old to use the Service. If you are between 13 and 17 years old, you may only use it if a responsible adult in your Household (someone with the Owner or Administrator role, Section 4.2) expressly authorizes you to participate and supervises your use of the App. That adult is responsible for the activity you carry out within the Household they administer.

If you become aware that a child under 13 is using the Service without the authorization described here, please contact us through the means listed in Section 23 so we can take appropriate action.

3.2. Registration

You may access the Service with Google, Apple (Sign in with Apple), or an account created using an email address and password. If you choose Google, you authorize us to obtain the basic profile data needed to operate your account (name, email address, and profile photo, if you have one set). If you choose Apple, we use Apple's identifier and the data Apple shares to authenticate you; Apple may provide a private relay address, and your full name may be available only during the first authorization. If you choose email and password, we use your email address to identify and operate your account; your password is managed by our authentication provider and is not available to us in readable form. Use of your Google or Apple account is also subject to those providers' own terms.

3.3. Accuracy of information

You agree to provide truthful information and to keep it up to date (for example, your display name). You must not impersonate another person or create an account on behalf of a third party without their authorization.

3.4. Account security

You are responsible for keeping the credentials you use to access the Service confidential, whether they are your Google or Apple account credentials or your email account password, and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized use.

4. Households and Members

4.1. What a Household is

A "Household" is the shared space within the App where a group of people organizes their common expenses. A single person may belong to more than one Household.

4.2. Roles

Each Household has different roles with different permissions (for example, Owner, Administrator, and Member). The role determines what actions a person can take (such as inviting or removing members, creating or editing services, transferring ownership of the Household, and so on). It is your responsibility, and that of whoever administers each Household, to grant and manage these roles appropriately.

4.3. Invitations

Joining an existing Household requires an invitation code or link generated by a member with permission to do so. By accepting an invitation, you acknowledge that you will begin to see and share that Household's financial and expense information as described in Section 4.4.

4.4. Shared visibility of information within the Household

For shared services in a Household, you expressly agree that other members of that Household may see: your name and profile photo, the services and expenses assigned to you, the amounts attributed to you as payment responsibility, and the payment history you record or that other members record in relation to you within that Household. Services you mark as personal are visible only to you and are excluded from the Household's shared summary and metrics. This visibility separation is a feature of the Service.

We neither control nor can control how members of a Household use, among themselves, the information visible within that Household; any dispute over its use is a matter between those users (see Section 5).

4.5. Leaving and transferring a Household

A member may leave a Household at any time, unless they are the sole Owner and other members are active, in which case they must transfer ownership before leaving. Leaving a Household does not delete the payment history already recorded, which is retained to maintain traceability for the other members. The same rule applies when the Owner removes another person from the Household. Historical views will indicate when a person is no longer a Household member.

5. Nature of the financial information and responsibility between users

5.1. All information about expenses, splits, and payments shown in the App is manually entered by users themselves (or automatically generated from rules that users themselves configured, such as a service's recurrence). CasaEnOrden does not verify or reconcile this information against any external source (banks, receipts, invoices, etc.).

5.2. Any payment obligations that may exist among the members of a Household are the exclusive responsibility of those members toward each other. CasaEnOrden acts solely as an organizational tool and is not a party to any debt relationship, shared-expense agreement, or transaction between users. We do not guarantee the collection, payment, or fulfillment of any obligation recorded in the App, and we do not act as mediator, guarantor, or collector.

5.3. Any dispute between members of the same Household over amounts owed, payments not correctly reflected, or expense splits must be resolved directly between them. CasaEnOrden may, at its discretion and without obligation to do so, provide technical support to help understand what was recorded in the App, but will not arbitrate or resolve financial disputes between users.

6. Acceptable use

By using the Service, you agree not to:

a) Use the App for unlawful purposes or to record false information intended to deceive another Household member about real payments; b) Access or attempt to access accounts, Households, or information belonging to other users without authorization; c) Interfere with the operation of the Service, including attempts to breach its security, reverse-engineer it, or extract data in bulk without authorization; d) Use the Service to harass, defame, or harm another user, including through misuse of the financial information shared within a Household; e) Impersonate another person or organization.

Violating this section may result in suspension or termination of your account under Section 12.

7. User content and license

7.1. You retain ownership of the information you enter into the App (service names, amounts, notes, etc. — "User Content").

7.2. You grant us a limited, non-exclusive, revocable license to store, process, and display your User Content solely for the purpose of operating the Service (including showing it to the other members of the corresponding Household, under Section 4.4).

7.3. You represent that you have the right to enter the User Content you provide and that it does not infringe third-party rights.

8. Privacy and personal data

8.1. Processing of your personal data is governed by our Privacy Policy, available within the App, which details what data we collect (your Google or Apple account data or email address, depending on your access method, your Household information, the services, payments, and contributions you record, technical and diagnostic data, and usage analytics enabled by default during setup), the purposes for which we use it, with whom we share it, and how you can exercise your rights or change your analytics preference.

8.2. We process your personal data in accordance with Law No. 29733, Peru's Personal Data Protection Law, and its regulations. You have the rights of access, rectification, cancellation, and opposition ("ARCO" rights), as well as the right to data portability, which you may exercise by writing to us through the means listed in Section 23.

8.3. We use external providers to operate the Service (for example, authentication through Google, Apple, or email and password, cloud storage/infrastructure, and purchase management through RevenueCat and the applicable stores). These providers process your data as data processors, solely to provide us with their contracted service, and may store information on servers located outside Peru; in such cases, we take reasonable contractual and technical measures consistent with applicable Peruvian law.

8.4. If you are under 18 and use the Service in accordance with Section 3.1, the responsible adult who authorized you may exercise the rights described in this section on your behalf.

9. Notifications

By using the Service, we may send you reminders and notices related to your activity in the App (for example, upcoming service due dates), through local notifications on your device or push notifications, if you enable them. You can turn them off at any time from your device or App settings.

10. Availability, changes, and discontinuation of the Service

10.1. We work to keep the Service continuously available, but we do not guarantee that it will operate without interruptions, errors, or delays.

10.2. We may modify, add, suspend, or discontinue features of the Service, in whole or in part, at any time, with or without prior notice, without this giving rise to liability toward you, unless applicable law provides otherwise.

11. Intellectual property

The Service, its name, brand, design, source code, and interface are owned by the Provider or its licensors and are protected by applicable intellectual property laws. These Terms do not grant you any rights over these elements, other than the limited license to use the Service as described here.

12. Suspension and termination of accounts

12.1. We may suspend or cancel your access to the Service, temporarily or permanently, if you breach these Terms, if your use poses a risk to other users or to the Service, or if a competent authority requires us to do so.

12.2. You may stop using the Service at any time. See Section 13 regarding deletion of your account and data.

13. Deletion of your account and data

13.1. You can start deleting your account from Settings → Account → Delete account within the App. If you cannot access the App, request deletion by writing to contacto.casaenorden@gmail.com. Before confirming, you must leave all Households you belong to and, if you are the sole Owner of any Household with other active members, transfer its ownership to another member (Section 4.5). If you have an active auto-renewing Plus subscription, you must first cancel it in Apple or Google subscription settings and wait for the cancellation to be reflected in the Service. Deletion retains only shared historical information needed by other Household members and records we must retain by law or to resolve disputes, as described in our Privacy Policy.

13.2. Once your account is deleted, we will stop using your personal data for new purposes, without prejudice to information we must retain due to a legal obligation or to substantiate the payment history toward other members of a Household you belonged to, as described in our Privacy Policy.

14. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR ACCURACY OF INFORMATION CALCULATED FROM DATA THAT USERS ENTER.

15. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PROVIDER WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR FOR LOSS OF MONEY, OPPORTUNITIES, OR INFORMATION, ARISING FROM USE OR INABILITY TO USE THE SERVICE, INCLUDING ANY FINANCIAL DISPUTE BETWEEN HOUSEHOLD MEMBERS (SECTION 5). This limitation does not exclude liabilities that cannot be limited under Peruvian law or the law of the country from which you access the Service, where such law applies on a mandatory basis.

16. Indemnification

You agree to indemnify and hold the Provider harmless from any claim, damage, or expense (including reasonable legal fees) arising from: (a) your breach of these Terms; (b) your misuse of the Service; or (c) your violation of a third party's rights, including another member of your Household.

17. Geographic availability

17.1. The Service is launching initially in Peru, and we plan to progressively expand it to other countries, including the United States.

17.2. The Service is not directed to, and is not currently offered to, individuals located in the European Economic Area, the United Kingdom, or Switzerland, and these Terms have not been designed to comply with the General Data Protection Regulation (GDPR) or equivalent regulations of those jurisdictions. If you access the Service from any of those territories, you do so on your own initiative and are responsible for complying with applicable local law; we reserve the right to restrict access from those locations.

17.3. As the Service becomes available in new countries, we may add additional or country-specific terms (for example, additional notices required by local law), which will be added as annexes to these Terms or notified to you in a timely manner.

18. Users in the United States and children under 13

If you use the Service from the United States, please note that we do not knowingly collect personal information from children under 13 without the involvement of a responsible adult under Section 3.1, consistent with the principles of the Children's Online Privacy Protection Act (COPPA). If you have reason to believe we have collected data from a child under 13 without proper authorization, please contact us immediately (Section 23) so we can delete it.

19. Changes to these Terms

We may update these Terms from time to time. If changes are material, we will notify you within the App or through another reasonable means before they take effect. Continued use of the Service after such changes take effect constitutes your acceptance of the updated Terms.

20. Governing law and dispute resolution

20.1. These Terms are governed by the laws of the Republic of Peru, without regard to its conflict-of-laws rules.

20.2. Any dispute, disagreement, or claim arising from these Terms or from use of the Service that cannot be resolved through direct negotiation between the parties within thirty (30) days will be resolved by arbitration at law, administered by the Arbitration Center of the Lima Chamber of Commerce (Centro de Arbitraje de la Cámara de Comercio de Lima), under its rules in effect at the time the arbitration is initiated, seated in Lima, Peru, before a sole arbitrator, and conducted in Spanish. The award will be final and binding on the parties. (The Provider may substitute the arbitral institution named here for an equivalent one, recorded in an update to these Terms under Section 19.)

20.3. Nothing in this clause limits the non-waivable rights granted to you under Peru's Consumer Protection Code (Law No. 29571), including your right to file a complaint with INDECOPI.

21. General provisions

21.1. Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect.

21.2. Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Provider regarding the Service.

21.3. Assignment. You may not assign your rights or obligations under these Terms without our prior consent. We may assign these Terms in connection with a business reorganization (for example, if the Service comes to be operated by a legal entity in the future), notifying you in a timely manner.

21.4. No waiver. Failure to exercise a right under these Terms does not constitute a waiver of that right.

22. Language

These Terms are originally drafted in Spanish. If translations into other languages are offered (for example, English, as the Service expands to other countries), the Spanish version will prevail in the event of any discrepancy, unless applicable local law requires otherwise.

24. Free plan, Plus, and store purchases

24.1. The free plan allows one owned Household, up to two active members per Household, up to five active shared services per Household, and up to five active personal services per account. Joining a Household by invitation is free. If you are a member of someone else's Household and want to create and keep an owned Household at the same time, you need Plus; you may first leave the invited Household to create your first free Household.

24.2. Plus increases the plan's capacity limits. The App shows the localized price and billing period provided by RevenueCat and the applicable store before you confirm a purchase. Prices may vary by country, currency, taxes, store requirements, or changes disclosed before renewal.

24.3. Subscriptions are purchased only through Apple App Store or Google Play, depending on your device. The store charges, manages auto-renewal, receipts, plan changes, cancellations, and refunds under its own terms. You can cancel in the store's subscription settings and retain Plus through the already paid period. We do not issue payment receipts inside the App.

24.4. CasaEnOrden does not currently offer a free trial. Existing courtesy Plus access granted internally is not a store subscription and may be administered or revoked separately.

24.5. A purchase is linked to one CasaEnOrden account. RevenueCat handles restoration and the server mirror grants access only after the RevenueCat entitlement is confirmed. If a purchase is linked to another account, contact us without emailing receipts or payment details.

24.6. When Plus expires and no other valid access source exists, you retain access to view your data and reduce use, but cannot increase capacity until you return within the free plan or purchase Plus.
